Terms of Service
These Terms govern your use of PromptFax, a fax sending service operated by Cogint Labs LLC. By using PromptFax, you agree to these Terms.
Using PromptFax
PromptFax lets you upload or assemble pages, enter a US destination fax number, authorize payment, and send a fax. You are responsible for the documents you upload, the destination number you enter, and confirming that you have the right to send the fax.
Acceptable Use
You may not use PromptFax to send unlawful, harassing, fraudulent, abusive, infringing, or malicious content. You may not interfere with the service, attempt unauthorized access, evade limits, or use PromptFax in a way that violates telecom, privacy, consumer-protection, or anti-spam laws.
No Emergency or Regulated Secure-Fax Use
PromptFax is not an emergency service. PromptFax does not claim to be HIPAA compliant and does not provide a business associate agreement or regulated secure-fax agreement. Do not use PromptFax where those requirements apply.
Payment and Billing
PromptFax prepares a quote before sending. Payment authorization is processed by Stripe for Cogint Labs LLC, the operator of PromptFax. PromptFax captures payment after fax delivery information is available.
Charges are based on delivered pages. If a 10-page fax delivers 8 pages before failing, the charge is based on 8 delivered pages. If a fax is not sent or no pages are delivered, no delivery charge is made unless a specific fee is clearly shown before you authorize payment.
Transmission and Delivery
Fax transmission depends on third-party networks, receiving fax machines, payment processors, cloud services, and fax providers. PromptFax will show the best status information available, but we cannot guarantee that any fax will be accepted, received, read, or acted on by the destination.
Third-Party Providers
PromptFax uses service providers for payment processing, hosting, storage, logging, and fax transmission. Those providers may process information as needed to provide their services.
Disclaimers
PromptFax is provided as is and as available. To the fullest extent permitted by law, Cogint Labs LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and error-free operation.
Limitation of Liability
To the fullest extent permitted by law, Cogint Labs LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, failed delivery, delayed delivery, or recipient actions.
Changes and Termination
We may change, suspend, or discontinue PromptFax or update these Terms. We may block or limit use that we believe violates these Terms or creates risk for PromptFax, users, providers, or others.
Governing Law
These Terms are governed by the laws of Massachusetts, without regard to conflict-of-law rules.
